What Happens When You’re Declared Persona Non-Grata?

Just imagine being unwanted in a place you have grown up since birth. The place where your childhood memories were once created, or what if being banned from the place you love and used to visit before? Just because of one mistake, everything has changed.

And that happens when you are being declared as Persona Non-Grata. 

The term “Persona Non Grata” means what exactly?

The Latin phrase “persona non grata” means “unwelcome person.” The term “person no longer welcome in a particular country” is a diplomatic term for this scenario. This may occur for various reasons, such as when someone poses a security risk or has broken the law.

In the Vienna Convention on Diplomatic Relations of the UN, it is recognized as an aspect of diplomacy. This is a code of conduct that controls how governments communicate with one another within the UN system.

A member of a diplomatic mission, such as the ambassador, charges d’affaires, or their staff, may be designated as “persona non grata,” which means the host nation “does not accept” them.

Without having to justify its choice, the receiving state may proclaim someone “persona non grata,” and it may do so even before the diplomat arrives. After that, the “persona non grata” would be subject to recall or termination and required to return to their own countries. In diplomatic language, it’s called being expelled from a country.

Puka Luka Vega Issue

In a recent event, drag performer Puka Luka Vega performed to an “Ama Namin” remix while dressed as the Black Nazarene. The performance was posted on social media and quickly drew the attention of netizens, Catholic and other religious groups, and government officials.

On Wednesday, August 16, the Cebu City Council declared Vega a “persona non grata,” meaning he was no longer welcome in the city; together with 11 other local towns, he was also banned from entering them.

The enactment of Vega as persona non grata has prompted a discussion about religious tolerance and freedom of expression. While some believe that Vega’s performance was protected by the Constitution’s First Amendment as free speech, others argue that it was an intentional display of disrespect.

Here are the New Revised Guidelines for International-Bound Filipino Passengers in 2023

It must be frustrating, but we must comply with the revised guidelines for our citizens’ safety. It’s better safe than never.

According to the revised guidelines announced a week ago, the immigration office (IO) may request the traveler to answer clarification questions and present the following supporting papers in addition to the inspection of basic travel documents.

Basic travel papers now include the following:

  • Passport, valid at least six months from the date of departure;
  • Appropriate valid visa, whenever required;
  • Boarding pass;
  • Confirmed return or roundtrip ticket, when necessary

For Tourists:

1. Self-funded Travels

  • a. Confirmed return or roundtrip ticket;
  • b. Proof of hotel booking/accommodation;
  • c. Financial capacity or source of income consistent with the passenger’s
  • declared purpose of travel; and
  • d. Proof of employment and other equivalent documents.

2. Sponsored Travels

2.1. If the sponsor abroad is a relative within the first (1st) civil degree of the passenger

  • a. Original Philippine Statistics Authority (PSA)-issued birth certificate/report
  • of birth or marriage certificate/report of marriage as proof of first (1st) civil
  • degree relationship;
  • b. Confirmed return or roundtrip ticket; and
  • c. Copies of the following documents of sponsor, such as:
  • i. Valid passport;
  • ii. Valid work visa/permit, residence permit or any equivalent document;
  • iii. Overseas Employment Certificate (OEC), E-receipt, or OFW Clearance, for OFW sponsors.

2.2. If the sponsor abroad is a relative up to fourth (4th) civil degree of consanguinity or affinity, unless otherwise limited by the Philippine Embassy or Consulate exercising jurisdiction

Original Affidavit of Support and Guarantee (AOSG) showing the information in Annex “B,” and is:

  • duly notarized by the Philippine Embassy/Consulate/Honorary Consulate authorized to perform notarization services; or
  • if the AOSG is notarized by a local notary public in the country of destination, the AOSG must be duly authenticated by the Philippine Embassy/Consulate/Honorary Consulate (for non-Apostille countries) or apostilled7 by the apostille authority in the country of destination  (for Apostille countries).
  • Confirmed return or roundtrip ticket; and
  • Original PSA-issued birth certificate/report of birth or marriage certificate/report of marriage showing the exact relationship between the passenger and the sponsor.

2.3. If the sponsor abroad is a non-relative or a legal/juridical entity

Original Affidavit of Support and Guarantee (AOSG) and is:

  • duly notarized by the Philippine Embassy/Consulate/Honorary Consulate authorized to perform notarization services;
  • or if the AOSG is notarized by a local notary public in the country of destination, the AOSG must be duly authenticated by the Philippine Embassy/Consulate/Honorary Consulate (for non-Apostille countries) or apostilled by the apostille authority in the country of destination (for Apostille countries)
  • Substantial proof of relationship;
  • Confirmed return or roundtrip ticket; and
  • if a legal/juridical entity, registration papers of the sponsor.

2.4. If traveling with a local sponsor

  • Duly notarized affidavit executed by the local sponsor
  • Substantial proof of relationship11:
  • Copy of the sponsor’s return ticket consistent with that of the passenger

Overseas Filipino Workers (OFWs)

1. OFWs Departing for the First Time

  • OEC, E-receipt, or OFW Clearance duly issued by the Department of Migrant Workers (MW) as appearing in the Border Control Information System (BCIS);
  • Valid and appropriate employment visa or work permit or any equivalent document;
  • Employment contract, as necessary; and
  • Visa Usage Undertaking13 or Manpower Request specifying visa usage approved or verified by the Migrant Workers Office (MWO), if applicable.

2. Balik-Manggagawa

  • Valid and appropriate employment visa/work permit or any equivalent document;
  • OFW Clearance, OEC issued on-site by the MWO or by the DMW or Migrant Workers Airport Assistance Center (MWAAC), or Online BM OEC Exemption or manually issued OEC:
  • And Proof of employment, as necessary.

3. Direct-Hire

  • OEC, E-receipt, or valid OFW Clearance; and
  • Proper and valid work visa/work permit or any equivalent document.

4. OFWs Requiring Special Travel Exit Clearance in lieu of OEC

  • Locally employed seafarers (conduction crew) who will be manning a Philippine Registered Ship’s conduction from a foreign port to the Philippines;
  • Seafarers who will undergo orientation and other analogous circumstances as a requirement before their employment, as the prospective foreign employer prescribes. The foreign employer must be accredited by a licensed local manning agency; and
  • Emergency change crew for Philippine registered vessels docked in international ports.

5. OFWs traveling to other countries during their vacation in the Philippines

  • If the OFW will travel to other country/ies for tourism, but will return to the Philippines before proceeding to his/her jobsite, the OFW shall undergo the usual immigration inspection for tourist travelers under this Guidelines.
  • If the OFW will travel to other country/ies for tourism, but will proceed directly to his/her job site, a valid OEC will be required.

6. Endorsement to the DMW-MWAAC

  • The IO shall promptly endorse a passenger to the DMW-MWAAC for validation of employment documents, updating of employment records, issuance of clearance, or other appropriate action, when confronted with the following:
  • the OEC of the OFW or MWO-registered worker is invalid, expired, used, or did not reflect in the BCISl; or
  • the OFW has incomplete or questionable documents.
  • In cases of endorsement to the DMW-MWAAC, the IO shall provide the passenger with a validation request form. Upon validation by the DMW-MWAAC, the passenger shall be directed back to the I0 for the completion of the immigration inspection.

The Inspection

Primary Inspection

2.1. The primary Immigration Officer (IO) of the Bureau of Immigration (BI) shall interview the passenger about the purpose of his/her travel and inspect the basic travel documents.

2.2. The IO may propound relevant clarificatory questions and require from the passenger additional supporting documents as enumerated in Part II of this Guidelines to establish the purpose of travel.

2.3. The primary IO shall clear the departure of a passenger who is able to sufficiently establish his/her declared purpose of travel.

2.4. The primary IO shall defer the departure of a passenger based on the following

grounds:

  • Presentation of fraudulent, falsified, or tampered travel or supporting documents; or refusal to undergo primary inspection

2.5. The primary IO shall refer the following passengers for secondary inspection:

  • Those who failed to establish their purpose of travel during primary inspection;
  • Those with inconsistent or insufficient travel or supporting documents;
  • Those unable to show proof of financial capacity to travel and are
  • accompanied by a foreign national who is not a relative by consanguinity or affinity up to the fourth (4th) civil degree;
  • Those traveling, with or without a visa, to countries under Alert Level Three (3) or Four (4) as determined by the Department of Foreign Affairs (DFA) and those with relevant deployment bans as determined by the

Department of Migrant Workers (DMW);

  • Those who previously stayed abroad for over six (6) months as a tourist or previously misrepresented any travel information, and are intending to travel again for the same purpose;
  • Those with active deferred-departure records; or
  • Those identified and reported by the IACAT Anti-Trafficking Task Force (IACAT-ATTF) or other government agencies as a potentially trafficked/illegally recruited person or a suspected trafficker/illegal recruiter.

Secondary Inspection

3.1. The secondary IO shall interview the passenger about the purpose of his/her travel and shall conduct further examination of his/her supporting documents which may include database referencing and referral of documents for laboratory examination.

3.2. During the inspection, the secondary IO shall consider the totality of the circumstances of the passenger which includes, but is not limited to, the purpose of travel, country/ies of destination, duration of stay, travel history, age, financial capacity or source of income consistent with the passenger’s declared purpose of travel, and educational background. Thereafter, the secondary IO shall either allow or defer the departure of the passenger.

3.3. The secondary IO shall defer the departure of the passenger upon a finding of any of the following grounds:

  • Refusal to undergo secondary inspection;
  • Doubtful purpose of travel;
  • Inconsistent or insufficient travel or supporting documents;
  • Misrepresentation or withholding of material information about the travel;
  • Presentation of fraudulent, falsified, or tampered travel or supporting documents;
  • Non-compliance with previous deferred-departure requirements; or
  • he passenger is a potentially trafficked or illegally recruited person, or a suspected trafficker/ illegal recruiter.

The coffee taste is strong but it’s not too bitter. It’s smooth and is actually quite a lovely drink. It might have been Team Sugbo’s favorite, second to the IPL (Indiane Pale Lager).

Philippine Immigration released New Guidelines Abroad Starting in September

Regardless of the recent incidents that happened a while ago, such as having an offload incident or travelers missing their flights because of the interrogation of the immigration officer.

The Bureau of Immigration has formally released strict guidelines for Philippine Immigration 2023 Abroad. It was first published on August 18 and will officially start on September 3. 

According to Dana Sandoval, spokesperson of the Bureau of Immigration, ” Those traveling who doesn’t have a sponsor or just a regular tourist, they don’t need to worry about the said guidelines.”

Here are the guidelines when traveling:

Basic Travel Documents

a. Passport, valid at least six months from the date of departure;

b. Appropriate valid visa, whenever required;

c boarding pass; and

d. Confirmed return or roundtrip ticket when necessary.

Sponsored Travel

A traveler with a sponsor abroad must provide an original affidavit of support or guarantee showing the exact relationship between the passenger and the sponsor.

On the other part of the guidelines, a traveler with a sponsor for tourism purposes must provide a document showing it must be for tourism purposes. 

Thus, it is necessary to comply with the obligation of sponsorship to ensure the assessment of the passenger’s future travels and the capacity of the sponsor invitation.

Nonetheless, according to the Inter-Agency Council Against Trafficking (IACAT), The revised guidelines received many complaints from travelers and criticism. The council corroborates that the guidelines released are intended for something other than the right travel. However, to protect the Filipinos from dangers and human trafficking.

Potato Corner was on the hunt for the next Miss U! No, not really. They are, however, looking for service crew members who meet certain physical criteria. And boy, are those qualifications specific!

Potato Corner, a popular snack business, is in hot water after a job posting for a soon-to-open branch went viral due to its discriminatory recruiting demands.

Apparently, the branch prefers “visually appealing” employees with a “pleasing personality.” They also want them to be of proportionate weight and have a clear complexion, good eyesight, and a good set of teeth.

Social media users quickly slammed the post, accusing Potato Corner of discriminating against people based on their appearance. Others who commented laughed that the job posting was for a beauty pageant rather than a fast-Food restaurant position.

Potato Corner has eventually apologized for the job advertising, calling it a “well-meaning but insensitive” mistake. The company stated that it does not support or condone discriminatory employment practices and is dedicated to promoting an inclusive environment.

“We deeply regret the oversight in the job posting,”

said Potato Corner.

The company additionally explained that the job advertisement was not authorized by its headquarters and is working to avoid similar events in the future.

What is the difference between Student Visa and Study Permit?

A student visa (TRV) allows you to enter Canada, but it does not allow you to stay and study there. A study permit will enable you to study and remain legally in Canada as a student. It is usually issued at the port of entry (POE) and stapled to your passport with your TRV and enrollment letter when you first enter Canada. A student visa is a study permit in Canada. The Regular Stream or Study Direct Stream (SDS) is available for applications.

  2. Meet the language requirements. You must meet the English language requirements to study in Canada. This entails taking and passing an English language proficiency test. The required score varies based on the institution and program you are applying to.
  3. Apply for a study permit. After being accepted into a program and passing the language requirements, students from the Philippines must have a study permit to study in Canada. The study permit is a document that permits you to study in Canada.

  • A letter of acceptance from a designated learning institution (DLI)
  • A valid passport or travel document.
