Daanbantayan Bans Shirtless Strolls in Public Places

Going shirtless may be common in the heat, but residents and visitors in Daanbantayan will now have to be more mindful of where they do it. A new municipal ordinance prohibits topless or half-naked appearances in public places across the northern Cebu town, with penalties increasing for repeat violations. Here is what you need to know about the new rule and where it does not apply.

Public Places Covered

Municipal Ordinance No. 11-2026, formally called the “Anti-Topless (Shirtless) or Half-Naked in Public Places Ordinance of the Municipality of Daanbantayan,” applies to both men and women within the municipality. It prohibits appearing without customary top apparel covering the upper half of the body in public areas. The ordinance specifically identifies places such as public streets, plazas, government offices, and other areas accessible to the public.

The Sangguniang Bayan approved the measure unanimously on third and final reading during its regular session on Sept. 4, 2026. It was authored by Sangguniang Bayan Member Jose Maria C. Gastardo and later approved by Mayor Gilbert Arrabas Jr. on Sept. 17. According to the Municipal Council, the ordinance aims to regulate conduct in public places, maintain public order, prevent disturbances, and promote community welfare.

Not For Every Setting

The ban does not apply to every situation where a person may be without customary upper-body clothing. The ordinance provides exemptions for cultural practices and religious rituals, as well as breastfeeding mothers and infants. Beaches, resorts, private properties, and sporting events are also excluded from the prohibition.

Certain work environments are likewise exempted, particularly jobs where workers may be exposed to extreme heat. Construction workers and laborers working under such conditions are among those covered by the exemption. This means the ordinance is specifically focused on public places and does not prohibit shirtless activity in all circumstances.

Penalties For Violators

The penalties become heavier with repeated violations. A first offense may result in a warning or community service, while a second offense carries a ₱1,000 fine. For a third and succeeding offense, the ordinance provides for a ₱2,000 fine or imprisonment.

The Philippine National Police, barangay tanods, and municipal enforcement teams are tasked with implementing the ordinance. An apprehended person who does not wish to contest the violation may also voluntarily pay the administrative fine to the Municipal Treasurer within 24 hours of apprehension. The provision is intended to allow the person to avoid formal criminal prosecution, with an official receipt issued for every payment.

When It Takes Effect?

The ordinance will take effect 15 days after it is posted on the municipal hall bulletin board and in at least two other conspicuous public places within Daanbantayan. The municipality also plans to use signage and educational campaigns to inform residents and visitors about the new rule.

For those visiting Daanbantayan, particularly travelers heading to its popular beaches and resorts, the ordinance comes with clearly stated exemptions. However, shirtless or topless appearances in public streets and other covered areas are now subject to the new municipal rules.
